Welcome to Hadassah Healing Oils. We are so glad you are here. Make yourself comfortable and enjoy this Site which has been birthed out of passion and the personal calling of Lechi van Rooyen. But please follow our house rules and respect that by law, we have to have certain legal measures in place.

This document and the other documents that we reference below make up our house rules or what we officially call our “Terms and Conditions” (the “Terms” for short).

The Terms are a legally binding contract between you and Hadassah Healing Oils. This contract sets out your rights and responsibilities when you use www.hadassahhealingoils.com, our Facebook and other social media pages (referred to as “the Site”), so please read it carefully.

By using this Site (even just browsing), you are agreeing to these Terms. If you do not agree, then you may not use this Site.

We know that your privacy is important to you and so it is important to us. Our Privacy Notice sets out how we use your personal information that is collected, used and shared when you use the Site. Please read it here.

Disclaimer

On this website, you will find information on various essential oils, blends and protocols that can be used for certain medical conditions. You are ultimately responsible for your health and safety and although we believe in the efficacy of these oils and protocols, the Site is not a substitute for medical diagnosis or treatment by a health care practitioner. As such, the law requires us to have appropriate disclaimers on our website. Please read our Disclaimer here.

Refunds and return policy

We strive to provide you with the best products and quality services. However, sometimes things do go wrong or need change and so we have a Refunds and Returns Policy. Please read it here.

Distributors policy

Should you wish to become a distributor of our products, you can contact us. You will enter into a separate agreement with us if your application is approved. The Distributors contract can be found here. Additionally, these Terms in their entirety also apply to you.

2. WARRANTIES AND LIMITATION OF LIABILITY

Hadassah Healing Oils strives to make the Site to function well but you understand that things can go wrong. We provide the Site “as is” and without any kind or warranty (express or implied).

We do not warrrant that:

The Site will be secure, error-free, reliable or available at any particular time or location;
Any defects or errors will be corrected;
The Site will be free of viruses or other harmful materials; or
The results of using the Site will meet your expectations.

You use of the Site, information contained therein and products sold, are solely at your own risk.

Hadassah Healing Oils shall not be liable for any lost profits or revenues or for any indirect or consequential, indirect, special or punitive damages arising out of or in connection with the Site. In no event shall Hadassah Healing Oils’ aggregate liability for any damages exceed R500 (Five hundred Rands).

Hadassah Healing Oils, our affiliates, and our respective directors, officers, employees, agents, representatives, distributors and third party providers (“Protected Parties” hereafter), shall not be liable for direct, indirect, incidental, punitive or consequential damages whether arising out of contract, delict or otherwise and you hereby waive any claim against the Protected Parties and release the Protected Parties from any liability for any loss or damage of any kind arising from:

Your use of the Site;
Functionality or content that is available through the Site;
Any action or inaction on the part of the Protected Parties as a result of any communications you send; and/or
Delayed or inability to use the Site.

Any claim that you do wish to bring against Protected Parties, shall be made within 12 months of the cause of action arising.

3. INDEMNITY

If Hadassah Healing Oils gets sued for something that you did wrong, you agree to defend and indemnify us. That means you will defend Hadassah Healing Oils and hold us harmless from any legal claim or demand (including reasonable attorneys’ fees) that arises from your actions, our use (or misuse) of our Site, your breach of these Terms of Use or your infringement of someone else’s rights.

4. Binding Sales Agreement

By using the Site, You are bound by these Site Terms and Conditions.

A binding sales agreement between Hadassah Healing Oils and you comes into force when:

you have placed an order for selected Products and thereby made an offer to purchase them from Hadassah Healing Oils; and
you have made payment to Hadassah Healing Oils; and
Hadassah Healing Oilshas notified you that it has accepted your offer and that it will dispatch the order.

If you have placed an order, it is deemed that you have made an offer to purchase to Hadassah Healing Oils who in its sole discretion may accept or decline the offer. Taking payment from you via credit card or EFT does not indicate acceptance of the offer to purchase and Hadassah Healing Oils will immediately refund you in case your offer has been declined. The autoresponse sent to you after you have placed an order does not constitute an acceptance of your order.

5. Payment and Pricing

If Hadassah Healing Oils has not received your payment, we are under no obligation to dispatch the Products to you.

6. Invoices

The Hadassah Healing Oils shall issue an invoice after accepting the order.

7. Shipping Policy

When we accept your offer to purchase via the order form, we will dispatch your Products within 3-5 working days. After dispatch, delivery to major centres will take place within 2 business days and up to 2-4 business days in outlaying areas.

Delivery charges are calculated automatically by the Site. However, calculation errors may occur and we may notify you of such and either pass a refund or require an additional charge to cover the delivery.

When an order ships, you will receive a Tracking number.

Once the Products have reached your Shipping Address, the risk passes to you for any loss or damage to the Products.

If you have received damaged Products which may include breakage or leakage, please contact us immediately for an assessment.

8. Incorrect Pricing

Hadassah Healing Oils always verifies prices as part of its fulfilment process. If a Product has been listed at an incorrect price accidentally, Hadassah Healing Oils reserves the right to cancel your order. In that case Hadassah Healing Oils will contact you with the option of either paying the correct amount and/or accepting a refund.

9. Product Descriptions

Hadassah Healing Oils strive to provide accurate product descriptions. We however do not warrant that product description or other content on the Site is accurate, complete, reliable, current or error-free.

If you have received an incorrect product, your sole remedy is to return it to us in an unused and unopened condition and we will send you the correct product.

10. Cooling Off Right

The Cooling off right in terms of the Electronic Communications and Transactions Act, does not apply to this transaction.

11. Changing or Cancelling an Order

If you changed your mind and would rather like to cancel the order, we can offer the following two options:

you may contact us and reference your order number and if we have not dispatched the order yet, we will issue you a store credit or change the order as requested; or
if we have already dispatched the Products, you may still cancel the order and receive a store credit but you will be responsible for the fees for returning the Products to us via our appointed courier. The package as received, must however be unopened and sealed to be eligible for return.

The above options however do not apply to Products we custom blended for you.

12. Product returns

Should you need to invoke a warranty of a Product you bought on the Site, whether one of Our Products or a product of one of our third party suppliers, please contact us directly. Some of our third party suppliers wish users to send the defective products to them directly and others wish users to return the products to us.

However, we will assist you as far as possible and facilitate the process.

Description of the main characteristics of the Service offered by the supplier: We offer a variety of pure essential oils and special blends to be used by human beings.

For as long as a Site user uses the website to browse or to place orders.

14. Electronic Communications

You accept that Hadassah Healing Oils may communicate with you through email for the following reasons: sending you notifications of special promotions and competitions, informing you of changes to the Site terms and conditions and for providing customer service.

You may elect not to receive electronic marketing messages from us and may opt-out using the mechanism provided. Hadassah Healing Oils however reserves the right to notify you of changes to these terms and conditions, and to the Site in general.

When Hadassah Healing Oils sends an email to you, it is deemed that you have received it when you are capable of downloading the email.

When you send an email to Hadassah Healing Oils, it is deemed to have been received when it replies to the message.

You agree that all electronic notices, disclosures and other communications between Hadassah Healing Oils and you, satisfy any legal requirement that such communications be in writing.

15. Coupons

From time-to-time, Hadassah Healing Oils may offer promotional coupons or discounts (“Coupons”). This may take the form of a “Fixed Coupon” which is for a fixed amount of for example R100. It may also take the form of a “Percentage Coupon” which is for a certain percentage discount for example a 10% discount.

Coupons are issued at our sole discretion and similarly, we are entitled to correct, cancel or reject a Coupon for any reason. Coupons cannot be earned and users do not have a right to Coupons.

As a general rule, and unless a specific Coupon indicates otherwise:

A Coupon can only be redeemed once;
Only one Coupon can be used per order;
Only one Coupon can be used on the website per person per promotion;
A Coupon must be used at check-out;
The value of the Coupon will be set off against the value of your order and the balance will be payable by you.

Coupons cannot be used to buy Gift Vouchers and cannot be exchanged or refunded for cash or credit.

Hadassah Healing Oils is not responsible for any harm due to the loss, unauthorised use or distribution of a Coupon.

Coupons must be used before the stated expiry date.

If you have placed an order using a Coupon but you have subsequently cancelled the Order, you will receive a store credit to the amount actually paid by you. That means, if the order was to the value of R1000 but you used a R100 Coupon, you actually paid R900 for the order and you will receive a store credit for R900.

16. Complaints and Disputes

Hadassah Healing Oils undertakes to resolve any disputes internally as far as practically possible.

17. Changes to Site

Hadassah Healing Oils reserves the right to amend these terms and conditions in its sole discretion, by posting the new terms on the Site and/or notifying you by email using the last email address you gave Hadassah Healing Oils.

You must acquaint yourself with any such amendments to the terms and conditions and they will take effect from date of notice.

18. Governing Law

The Laws of the Republic of South Africa govern the interpretation and validity of this Agreement.

19. General

You acknowledge that Hadassah Healing Oils uses third party vendors to provide the necessary hardware, software, networking, storage, and related technology required to provide access to the Site.

These terms and conditions form the whole agreement between the Parties and supersede all prior agreements, other representations and understandings.

If a certain clause in this agreement is found not to be unenforceable, that clause will be removed but the rest of the terms and conditions will still be valid.

Even if this agreement is terminated, the following clauses will continue to apply: Intellectual Property Rights, Disclaimer and Limitation of Liability, Governing Law and General.

20. Interpretation and Definitions

“Intellectual Property” refers to any copyrights, moral rights, goodwill, trade marks, source code, software applications, trade secrets or similar intellectual property rights;

“Our Products” refers to the essential oils both in their pure and blended forms as manufactured, provided and sold by Hadassah Healing Oils;

“Party/Parties” refers to either Hadassah Healing Oils or to you;

“Personal Information” refers to the Personal Information you supply to Hadassah Healing Oils or that it collects about you. It includes all the information as defined by the Protection of Personal Information Act 4 of 2013;

“Process or Processing” means any operation or set of operations including collection, receipt, collation, storage, updating, modification, retrieval, consultation, use, distribution, merging, linking, restriction and destruction;

“Seller” means a person or business that operates a shop on the Site through which it sells products;

“Site” refers to the official Site address: www.Hadassah Healing Oils.co.za

“Third Party” refers to a party that is not a party to this agreement;

“Third Party Products” refers to products sold on the Site and which falls outside the definition of “Our Products”;

“Your Testimonial” refers to photos, opinions, images or text relating to the use of Our Products.
