Terms of Use

These Terms of Use form part of the Site Terms and Conditions of the Hadassah Healing Oils Site (the “Site”). In this document, you will find information on the appropriate use of our Site and social media pages. Reference to “we, us, our” refers to Hadassah Healing Oils (Pty) Ltd.

1. Your right to use the site

Hadassah Healing Oils gives you a limited non-exclusive, non-transferable and revocable license to view and use the Site for your personal and non-commercial use. This right is subject to your compliance with these Terms of Use. We may at any time and for any or no reason revoke this limited right. All rights not expressly granted are reserved by Hadassah Healing Oils.

2. Prohibitions

You must not copy, reverse engineer or modify this Site or any of the content without Hadassah Healing Oils’ written consent. Without our written consent, you may not publish, reverse engineer or create derivative works from, license or otherwise exploit the content on this Site or any of Hadassah Healing Oils’ Intellectual Property.

You must not intentionally try to harm the Site which causes a disruption e.g. by overcoming the security measures that protect the Site or delivering viruses or other harmful code to the Site or causing excessive requests to be made to the Site.

You must not frame or mirror any page of this Site without Hadassah Healing Oils’ consent.

3. Your account with hadassah healing oils

You would need to register an account with Hadassah Healing Oils in order to buy products.

Upon registration of an Account, you:

Must choose a username and password;
Must maintain the confidentiality of the username and password;
Must report unauthorised use or suspected compromise of the username and/or password to Hadassah Healing Oils;
Accept responsibility for all actions carried out with your username and password. Hadassah Healing Oils and other Site Users may assume that any actions carried out were done with your authorisation;
Are responsible for all submissions made on the Site; and
Must be at least 18 years old.

If Hadassah Healing Oils suspects fraudulent or other criminal activity on your part while using the Site or in case of breach of these terms, or if the conduct in any way negatively affects the rights and interests of Hadassah Healing Oils, it may in its sole discretion temporarily suspend or terminate your access to the Site. In such circumstances, Hadassah Healing Oils will send you a suspension notice unless in its sole discretion it deems that such notice will lead to further damage and violation.

Hadassah Healing Oils reserves the right to institute criminal action against you for any illegal use of the Site.

4. Intellectual property rights

Hadassah Healing Oils either owns or has been licensed to use the copyrights and trademarks in this Site. All content included in the Site such as text, graphics, images, digital downloads, and software is protected by Copyright. These terms of use do not grant you any intellectual property rights in the Site. Hadassah Healing Oils reserves all rights not expressly granted. All Hadassah Healing Oils’ Intellectual Property are its property and you may not use them without written consent. You may not remove any copyright or trademark notices from copies of the content from this Site without our express written consent.

5. Your testimonials and reviews

We love receiving your testimonials. Should you provide us with a testimonial which may include photos, personal information such as your name, area you live in, your medical condition and your opinion of and/or experience with using Our Products (collectively “Your testimonial”), we acknowledge that it is your copyright. However, by submitting Your Testimonial to us, you provide us with a worldwide, non-exclusive, assignable, royalty-free, perpetual irrevocable right to use, publish, reproduce, distribute, create derivative works of and to publicly display Your Testimonials.

Your Testimonial that you post on the Site is Your Testimonial. This includes photos, reviews, comments, videos etc. We don’t make any copyright claims to it. You warrant that you own and have the right to make such submissions to us and that you will not infringe, or disclose without permission or otherwise violate any intellectual property of a third party and that you will not submit unlawful, fraudulent, abusive, defamatory, obscene or otherwise objectionable content to this Site.

You are solely responsible for Your Testimonial. You warrant that you either own or have the legal right to Your Testimonial and that you are not infringing a third party’s rights by posting it.

If you would like to remain anonymous, we respect that and please ask that you indicate to us your preference otherwise, we will post the name as provided with Your Testimonial.

When posting Your Testimonial on the Site, you give Hadassah Healing Oils a non-exclusive, worldwide, royalty-free, irrevocable, sub-licensable, perpetual license to use, display, edit, modify, reproduce, distribute, store and prepare derivative works of Your Testimonial. You agree that none of Your Testimonial that you submit to us will be subject to any obligation on our part to keep the confidentiality and that we will not be liable for any use or disclosure of such submissions. You agree that any submission of Your Testimonial to the Site is at your sole risk and that we are not responsible for any loss of such submission, any loss of confidentiality or privacy in connection therewith or any other loss or liability relating to such submission. We reserve our discretion to publish or not to publish Your Testimonial.

Help us to improve Hadassah Healing Oils. If you submit ideas for improving the Site, such ideas you submit to us are considered non-confidential and non-proprietary to you. You give us a non-exclusive, worldwide, royalty-free, irrevocable, sub-licensable, perpetual license to use and publish those ideas and materials for any purpose, without compensation to you.

6. Links to third party websites

Hadassah Healing Oils occasionally runs promotional competitions that are free to enter.

Should you wish to enter, you must complete the online competition entry form before the stated deadline of the competition, accept the terms and conditions and submit the form.

Our competition rules are as follows:

Your entry into the competition and/or your acceptance of a prize (in the event that you win a prize) constitutes your binding acceptance of the terms and conditions on behalf of yourself and any person with whom you may share a prize (in the event that you win a prize which is for you and one or more additional persons (“your partner”).
The competition is not open to directors, members, partners, agents, employees or consultants of Hadassah Healing Oils or any of its affiliated companies or any supplier of goods or services in connection with a competition and the spouse, life partner, business partner or associate, or the natural or adopted parent, child, or sibling, of any of the persons specified above.
Only one entry per participant will be taken into consideration.
Entrants under the age of 18 must obtain permission from their parents or guardians before entering.
You may not participate in or win a competition if you have won a competition promoted by us within the past six months. You will be eligible to participate in a competition promoted by us after the expiry of six months after the date on which you won the last competition.
It is your responsibility to ensure that your entry is received by us prior to the closure of the competition. Any entries which are not received by us prior to the closure of the competition will not be eligible to participate, regardless of the reason for the late entry. We and our affiliates are not responsible for any entries which are not received by us, whether timeously or at all, regardless of the cause thereof.
We and our affiliates are not responsible for any injury or damage to your or any other person’s computer, mobile telephone or other device used by you to enter into, or obtain any materials related to, the competition.
It is your responsibility to ensure that any information which you provide to us is accurate, complete and up to date.
Any costs or expenses which you may incur other than in respect of those items specifically included in a prize are for your own account. Hadassah Healing Oils will not be responsible for any costs or expenses which you, or your partner (if applicable), incur during and for purposes of your entry into the competition and your acceptance and/or use of a prize.
We do not make any representations or give any warranties, whether expressly or implicitly, as to a prize, and in particular, but without limitation, make no representations and give no warranty that your entry or participation in the competition will necessarily result in you winning a prize, a prize, or any aspect thereof, will meet your, or, if applicable, your partner’s, requirements, preferences, standards or expectations; or a prize, or any aspect thereof, will be satisfactory, punctual, free from defects, safe or reliable.
We and our affiliates will not be responsible for any harm, damage, loss or claim relating to the provision of any element of a prize or any changes to a prize that may be made at any time.
Prizes are not transferable and may not be deferred, changed or exchanged for cash or any other item.
You may not win a prize if it is unlawful for us to supply such a prize to you. If you do win such a prize, you will forfeit it.
You must possess whatever documents and permissions that may be required in order to accept and use a prize, including, as regards international travel, a valid passport and all necessary visa and travel documentation, which documents and permissions it is your responsibility to obtain at your own cost, and which documents and permissions must remain valid in such minimum form and for such minimum period after the prize date as may be required by the relevant authorities.
The winners will be notified by means of the contact details provided to us. If we are, or a third party supplier is, unable to contact a winner within 30 days or if the winner is unable to collect the prize within 60 days, the winner will forfeit the prize and Hadassah Healing Oils reserves the right to re-draw a new winner under the same conditions.
In the event that you win a prize you agree to the publication of your name and to appear in person in the electronic media and the print media, and you agree, within reason, to endorse, promote or advertise our goods or services, for which no fee will be payable.
Hadassah Healing Oils may require you to provide us with such additional information as we may reasonably require in order to process and facilitate your acceptance and/or use of a prize.
In the event that you win a prize provided by a third party supplier, the supplier will contact you to arrange the collection thereof. In this regard, you must collect the prize at the time and date arranged with the supplier of the prize. All correspondence regarding the prize must be directed at the supplier of the prize. Hadassah Healing Oils will not be responsible for any further correspondence, harm, damage, loss or claim relating to the provision of any element of the prize.
Hadassah Healing Oils and its third party suppliers, as the case may be, reserve the right to vary, postpone, suspend, or cancel the competition and any prizes, or any aspect thereof, without notice at any time, for any reason which we deem necessary. In the event of such variation, postponement, suspension or cancellation, you agree to waive any rights, interests and expectations that you may have in terms of this competition and acknowledge that you will have no recourse against Hadassah Healing Oils, our affiliates and third party suppliers.
You agree that your participation in the competition, and your acceptance and/or use of a prize, or any aspect thereof, is at your own risk.
Hadassah Healing Oils and its affiliates will not be responsible, and disclaim all liability, for any loss, liability, injury, expense or damage (whether direct, indirect, incidental, punitive or consequential) of any nature, whether arising from negligence or any other cause, which is suffered by your participation in the competition or the acceptance and/or use by you, or your partner (if applicable), of any prize, or by any action taken by Hadassah Healing Oils or any of its affiliates in accordance with the terms and conditions.
You, and in the event of your death, your family, dependants, heirs, assignees or any other beneficiaries of your estate, indemnify and hold us and our affiliates harmless against any claim by you, or your partner (if applicable), (whether direct, indirect, incidental, punitive or consequential) of any nature, whether arising from negligence or any other cause, relating to any injury, loss, liability, expense and/or damage which you may suffer, howsoever arising, in relation to your entry into this competition and/or acceptance and/or use by you of a prize.
You acknowledge that the acceptance and use of a prize is subject to the proviso that all of the terms and conditions will apply to both you and your partner (if applicable), and you will ensure that your partner agrees to be bound and complies, and will continue to comply, therewith you will take full responsibility for your partner, you indemnify and hold Hadassah Healing Oils and its affiliates harmless against any claim by your partner or any third party in the event that your partner suffers any loss or damage pursuant to your partner’s acceptance and/or use of a prize and any minor will be accompanied by a parent or legal guardian.
If you fail or, if your partner (if applicable) fails, to comply with any of the terms and conditions, then without prejudice to any other remedy which Hadassah Healing Oils may have, you will be automatically disqualified and you will forfeit the prize/s (in the event that you have already won a prize), you will pay Hadassah Healing Oils for any loss or damage incurred by it directly or indirectly as a result of your (or, if applicable, your partner’s) non compliance, including all of our legal costs (including attorney and own client costs) which it may incur in taking any steps pursuant to your (or your partner’s) non-compliance.
You indemnify and hold Hadassah Healing Oils and its affiliates harmless against any claim by any person, (whether direct, indirect, incidental, punitive or consequential) of any nature, whether arising from negligence or any other cause, relating to any death, injury, loss and/or damage which may be suffered howsoever arising in relation to your failure (or that of your partner, if applicable) to comply therewith.
For purposes hereof, “affiliate” means Hadassah Healing Oils{‘s} partners, co promoters and sponsors of this competition, its subsidiaries, our and their subsidiaries and respective holding companies, the subsidiaries of their holding companies, and Hadassah Healing Oils{‘s} and their directors, officers, employees, agents and representatives.
These terms and conditions will be construed, interpreted and enforced in accordance with the laws of contract and dispute resolution in the Republic of South Africa.
Hadassah Healing Oils and the judges’ decision on any matter concerning the competition and/or arising out of these terms and conditions is final and binding on you, and no correspondence will be entered into.
